Terms of Service

1. Agreement to Terms
By accessing or using the START Canada mobile application ("App") and website offering (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Services.
Note for App Store Users: These Terms include the "Apple Device and App Store Terms" found in Section 12 below.
2. Services Description
START Canada provides career development services, including:
- Employability assessments and scoring
- Career bootcamps and training materials
- Professional certification pathways
- Mentorship connections
- Optional AI-powered recommendations based on profile and assessment data
- Optional AI analysis of uploaded resume and cover letter files
Services are subject to availability and may be modified or discontinued at any time.
3. User Accounts and Responsibilities
To use certain features, you must create an account. You agree to:
- Provide accurate and complete information.
- Maintain the confidentiality of your account credentials.
- Use our Services only for lawful purposes.
- Prohibited Conduct: You will not post or transmit any content that is illegal, abusive, harassing, hateful, pornographic, or otherwise objectionable. START Canada maintains a zero-tolerance policy for such content and reserves the right to immediately terminate the account of any user violating this rule.
4. User-Generated Content
You retain ownership of any content you submit (e.g., profile data, resume and cover letter files, feedback). By submitting content, you grant START Canada a non-exclusive license to use, display, and distribute such content for the purpose of operating the Services, including consent-based AI features that you enable.
5. AI Features and Consent Controls
Certain AI features are optional and require explicit consent. By enabling these features, you authorize START Canada to process relevant account data to provide AI outputs requested by you.
- Consent-Based Access: AI recommendations and AI resume/cover letter analysis are controlled through in-app privacy settings and first-use consent prompts.
- Separate Document Analysis Consent: Resume and cover letter AI analysis is separately controlled and can be enabled or disabled independently.
- Revocation: You may change or revoke AI consent settings at any time in app settings. Revocation applies to future AI processing under those settings.
- Third-Party Processing: Where required to deliver AI features, selected service providers may process data on our behalf under contractual safeguards.
- No Guaranteed Outcomes: AI outputs are informational only and do not guarantee employment, admission, or specific career outcomes.
6. Intellectual Property
All content, features, and functionality (excluding user content) are owned by START Group Consulting Inc. and are protected by copyright, trademark, and other laws. You may not reproduce or create derivative works without our express written permission.
7. Payment and Refunds
- Fees: Certain services may require payment. Fees are described at the point of purchase.
- In-App Purchases: Payments made via the Apple App Store or Google Play Store are subject to their respective terms and conditions.
- Refunds: Refunds for In-App Purchases are handled directly by Apple/Google, not START Canada. Please contact their support for refund requests.
8. Subscriptions (Auto-Renewable)
If you purchase a recurring subscription:
- Payment: Payment will be charged to your iTunes/Google Play Account at confirmation of purchase.
- Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
- Account Charged: Your account will be charged for renewal within 24-hours prior to the end of the current period.
- Management: You can manage your subscription and turn off auto-renewal by going to your Account Settings after purchase.
- No Cancellation: You cannot cancel the current subscription period once it touches the active period (but you can turn off the next renewal).
9. Limitation of Liability
To the fullest extent permitted by law, START Canada shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. We do not guarantee employment or specific career outcomes.
10. Termination
We reserve the right to terminate or suspend your access at any time, for any reason, including violation of these Terms.
11. Governing Law
These Terms shall be governed by the laws of the Province of British Columbia, Canada.
12. Apple Device and App Store Terms
If you are accessing the Services via an application on an Apple iOS device, the following additional terms apply:
- Parties: This Agreement is between you and START Canada only, not Apple. Apple is not responsible for the App or its content.
- Maintenance: Apple has no obligation to furnish any maintenance or support services for the App.
- Warranty: Apple is not responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation.
- Product Claims: START Canada, not Apple, is responsible for addressing any claims relating to the App or your possession/use of the App.
- Legal Compliance: You represent that (i) you are not located in a country that is subject to a U.S. government embargo, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
- Third Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
- Third Party Beneficiary: Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
