Terms of Service

1. Agreement to Terms

By accessing or using the START Canada mobile application ("App") and website offering (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Services.
Note for App Store Users: These Terms include the "Apple Device and App Store Terms" found in Section 12 below.

2. Services Description

START Canada provides career development services, including:

  • Employability assessments and scoring
  • Career bootcamps and training materials
  • Professional certification pathways
  • Mentorship connections
  • Optional AI-powered recommendations based on profile and assessment data
  • Profile Package tools for storing and managing employer-facing assets, including resumes, cover letters, credentials, certifications, publications, articles, white papers, reference materials, recommendations, and self-introduction videos
  • Private, revocable employer share links for assets you choose to make employer-visible
  • Optional AI document and credential analysis for eligible text-based assets you select for AI use

Services are subject to availability and may be modified or discontinued at any time.

3. User Accounts and Responsibilities

To use certain features, you must create an account. The Services are for people age 13 and older. You agree to:

  • Provide accurate and complete information.
  • Maintain the confidentiality of your account credentials.
  • Use our Services only for lawful purposes.
  • Prohibited Conduct: You will not post or transmit any content that is illegal, abusive, harassing, hateful, pornographic, or otherwise objectionable. START Canada maintains a zero-tolerance policy for such content and reserves the right to immediately terminate the account of any user violating this rule.

4. User-Generated Content

You retain ownership of any content you submit, including profile data, uploaded Profile Package assets, self-introduction videos, feedback, and support communications. By submitting content, you grant START Canada a non-exclusive license to use, host, display, process, and distribute such content only as needed to operate the Services, including account storage, employer sharing features you use, institution or program administration where applicable, and consent-based AI features that you enable.

You control which Profile Package assets are marked visible to employers. Employer share links are intended to be private and revocable, but anyone with an active share link may be able to view the employer-visible assets available through that link until it expires or is revoked.

5. AI Features and Consent Controls

Certain AI features are optional and require explicit consent. By enabling these features, you authorize START Canada to process relevant account data to provide AI outputs requested by you.

If you are a minor under the law where you live, a parent or guardian must give permission before you use AI features. Enrollment through a school or other institution does not replace that permission. If permission is not given or is withdrawn, you may continue using available non-AI features.

  • Consent-Based Access: AI recommendations and AI document and credential analysis are controlled through in-app privacy settings and first-use consent prompts.
  • Separate Document and Credential Analysis Consent: AI analysis of eligible documents and credentials is separately controlled and can be enabled or disabled independently.
  • Eligible Asset Selection: AI document and credential analysis applies only to supported text-based asset types, such as resumes, cover letters, education credentials, certifications, publications, articles, and white papers, when the required consent is enabled and the asset is selected for AI use.
  • Assets Not Used by AI Tools: Reference letters, recommendations, and self-introduction videos are not used by current AI document and credential analysis tools.
  • Revocation: You may change or revoke AI consent settings at any time in app settings. Revocation applies to future AI processing under those settings.
  • Third-Party Processing: We use OpenAI models through Amazon Bedrock for AI features. Relevant information is processed in the United States as described in our Privacy Policy.
  • No Guaranteed Outcomes: AI outputs are informational only and do not guarantee employment, admission, or specific career outcomes.

6. Intellectual Property

All content, features, and functionality (excluding user content) are owned by StartNew Technologies Corp. and are protected by copyright, trademark, and other laws. You may not reproduce or create derivative works without our express written permission.

7. Payment and Refunds

  • Fees: Certain services may require payment. Fees are described at the point of purchase.
  • In-App Purchases: Payments made via the Apple App Store or Google Play Store are subject to their respective terms and conditions.
  • Refunds: Refund eligibility for App Store or Google Play purchases follows the applicable store policy and your rights under consumer law. You can request a refund through the store or contact us for help.

8. Subscriptions (Auto-Renewable)

If you purchase a recurring subscription:

  • Payment: Payment will be charged to your iTunes/Google Play Account at confirmation of purchase.
  • Auto-Renewal: Your subscription renews automatically unless you cancel before the renewal deadline shown by the applicable store.
  • Account Charged: Renewal charges follow the price, billing period, and payment terms shown at purchase.
  • Management: You can manage your subscription and turn off auto-renewal by going to your Account Settings after purchase.
  • Cancellation: You can cancel through your store account settings. Cancellation normally stops future renewals; any remaining access and refunds follow the store policy and applicable law.

9. Limitation of Liability

To the fullest extent permitted by law, START Canada shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. We do not guarantee employment or specific career outcomes.

10. Termination

We reserve the right to terminate or suspend your access at any time, for any reason, including violation of these Terms.

11. Governing Law

These Terms shall be governed by the laws of the Province of British Columbia, Canada.

12. Apple Device and App Store Terms

If you are accessing the Services via an application on an Apple iOS device, the following additional terms apply:

  1. Parties: This Agreement is between you and START Canada only, not Apple. Apple is not responsible for the App or its content.
  2. Maintenance: Apple has no obligation to furnish any maintenance or support services for the App.
  3. Warranty: Apple is not responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation.
  4. Product Claims: START Canada, not Apple, is responsible for addressing any claims relating to the App or your possession/use of the App.
  5. Legal Compliance: You represent that (i) you are not located in a country that is subject to a U.S. government embargo, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
  6. Third Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
  7. Third Party Beneficiary: Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
